All furnishings and equipment provided are maintained to the best of our ability but since Owner has no control over what guests do or how things are used, Owner cannot guarantee functionality or safety. It is the responsibility of the guest(s) to take caution before using anything and to immediately notify the Owner if an item is not functioning properly or appears to be unsafe. Non-functioning amenities will be repaired as soon as reasonably possible therefore there is no refund promised. Arbitration -All claims or disputes between the Guest and the Owner arising out of or relating to the Contract Agreements shall be decided by arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association currently in effect unless the parties mutually agree otherwise. The award rendered by the arbitrator or arbitrators shall be final, and judgment may be entered upon it in accordance with applicable law in any court having jurisdiction thereof. If the Owner prevails the Guest shall be liable to the Owner for attorney’s fees and costs incurred by the Owner.
